2. Zakres Polityki Prywatności
Niniejsza Polityka Prywatności dotyczy serwisów internetowych, formularzy, portali, subdomen oraz innych usług internetowych MOTOEXPERT, które odsyłają do tego dokumentu.
Polityka obejmuje również przetwarzanie danych związane z:
obsługą zapytań i zleceń rzeczoznawczych;
organizacją oględzin pojazdów;
sporządzaniem opinii technicznych i wycen;
obsługą szkód komunikacyjnych i ubezpieczeniowych;
przesyłaniem zdjęć, dokumentów i innych materiałów dotyczących szkody;
prowadzeniem kont użytkowników i rzeczoznawców;
członkostwem w Stowarzyszeniu;
certyfikacją, szkoleniami i weryfikacją kwalifikacji;

kontaktem z klientami, rzeczoznawcami, partnerami, ubezpieczycielami i innymi uczestnikami postępowania dotyczącego szkody.
Niezależni rzeczoznawcy oraz przedsiębiorcy współpracujący z siecią MOTOEXPERT mogą w określonych sytuacjach działać jako odrębni administratorzy danych. Dotyczy to w szczególności przypadków, gdy rzeczoznawca wykonuje zlecenie we własnym imieniu i samodzielnie określa sposób przetwarzania danych. Informacja o roli danego podmiotu może zostać przekazana przy przyjęciu lub przekazaniu konkretnego zlecenia.
3. Jakie dane przetwarzamy
W zależności od rodzaju sprawy możemy przetwarzać:
imię i nazwisko;
adres zamieszkania lub adres prowadzenia działalności;
numer telefonu i adres e-mail;
nazwę firmy, stanowisko i dane osoby kontaktowej;
dane do wystawienia faktury i dokonania rozliczenia;
dane pojazdu, w tym markę, model, numer rejestracyjny, numer VIN, przebieg, wyposażenie i historię napraw;
informacje o zdarzeniu, miejscu szkody, jej przebiegu i uczestnikach;
dane właściciela, posiadacza lub użytkownika pojazdu;
dane kierowców, pasażerów, świadków, pełnomocników, pracowników warsztatów i innych osób związanych ze sprawą;
zdjęcia, nagrania, kosztorysy, faktury, kalkulacje naprawy, dokumenty pojazdu, dokumentację ubezpieczeniową i inne materiały dowodowe;
dane techniczne związane z korzystaniem ze strony lub portalu, takie jak adres IP, data i czas połączenia, rodzaj urządzenia, przeglądarka, system operacyjny, identyfikator sesji oraz historia logowania;
treść korespondencji, reklamacji, skarg, odwołań i zgłoszeń;
dane dotyczące wykształcenia, doświadczenia, uprawnień, specjalizacji i kwalifikacji kandydatów na członków, członków oraz rzeczoznawców.
Dokumentacja szkody może wyjątkowo zawierać informacje dotyczące zdrowia lub obrażeń uczestników zdarzenia. Takie dane przetwarzamy wyłącznie wtedy, gdy jest to niezbędne do ustalenia okoliczności szkody, dochodzenia roszczeń lub obrony przed roszczeniami albo gdy osoba wyraziła na to wyraźną zgodę.
Prosimy o nieprzesyłanie danych, zdjęć i dokumentów, które nie są potrzebne do rozpatrzenia sprawy.
4. Skąd otrzymujemy dane
Dane otrzymujemy przede wszystkim bezpośrednio od osób, których dotyczą. Mogą one również pochodzić od:
zleceniodawcy;
właściciela lub użytkownika pojazdu;
ubezpieczyciela, brokera lub likwidatora szkody;
pełnomocnika albo kancelarii prawnej;
warsztatu naprawczego;
rzeczoznawcy lub partnera MOTOEXPERT;
świadka lub innego uczestnika zdarzenia;
sądu, policji albo innego uprawnionego organu;
publicznie dostępnych rejestrów;
innego podmiotu uprawnionego do przekazania danych.
Jeżeli otrzymamy dane od innej osoby lub instytucji, realizujemy obowiązek informacyjny w zakresie i terminie wymaganym przez przepisy RODO.
5. Cele i podstawy przetwarzania danych
Dane osobowe przetwarzamy w następujących celach:
Obsługa zapytań i przygotowanie oferty
Dane przekazane telefonicznie, pocztą elektroniczną lub przez formularz wykorzystujemy do udzielenia odpowiedzi, przygotowania oferty oraz podjęcia działań przed zawarciem umowy.
Podstawą przetwarzania jest art. 6 ust. 1 lit. b RODO, a w przypadku kontaktu prowadzonego w imieniu firmy lub innej osoby – nasz prawnie uzasadniony interes wynikający z art. 6 ust. 1 lit. f RODO.
Realizacja zleceń rzeczoznawczych
Dane przetwarzamy w celu przyjęcia zlecenia, ustalenia terminu i miejsca oględzin, przydzielenia właściwego rzeczoznawcy, wykonania oględzin, sporządzenia opinii technicznej, wyceny pojazdu, kalkulacji kosztów naprawy, ustalenia wartości szkody, kontroli jakości oraz przekazania dokumentacji uprawnionym odbiorcom.
Podstawą przetwarzania jest art. 6 ust. 1 lit. b, c lub f RODO, zależnie od charakteru zlecenia i osoby, której dane dotyczą.
Obsługa portalu i przesyłanie dokumentów
Dane przetwarzamy w celu utworzenia i obsługi konta, potwierdzenia uprawnień użytkownika, umożliwienia przesyłania oraz pobierania dokumentów i zdjęć, prowadzenia historii zlecenia, zapewnienia bezpieczeństwa oraz zapobiegania nieuprawnionemu dostępowi.
Podstawą przetwarzania jest art. 6 ust. 1 lit. b i f RODO, a w zakresie obowiązków prawnych i bezpieczeństwa również art. 6 ust. 1 lit. c RODO.
Członkostwo, certyfikacja i szkolenia
Dane kandydatów, członków i rzeczoznawców przetwarzamy w celu rozpatrzenia wniosku, potwierdzenia kwalifikacji, prowadzenia rejestru członków i certyfikatów, pobierania składek, organizacji szkoleń i egzaminów oraz realizacji praw i obowiązków wynikających z członkostwa.
Podstawą przetwarzania jest art. 6 ust. 1 lit. b, c i f RODO.
Rozliczenia i obowiązki prawne
Dane przetwarzamy w celu wystawiania faktur, prowadzenia dokumentacji księgowej i podatkowej, obsługi płatności oraz realizacji innych obowiązków wynikających z prawa.
Podstawą przetwarzania jest art. 6 ust. 1 lit. c RODO.
Reklamacje, skargi i roszczenia
Dane mogą być wykorzystywane do rozpatrywania reklamacji, skarg i odwołań, wyjaśniania sporów, zabezpieczenia materiału dowodowego oraz ustalenia, dochodzenia lub obrony roszczeń.
Podstawą przetwarzania jest art. 6 ust. 1 lit. c i f RODO. Jeżeli dokumentacja zawiera dane dotyczące zdrowia, podstawą może być również art. 9 ust. 2 lit. f RODO.
Bezpieczeństwo serwisów i systemów
Dane techniczne i logi systemowe przetwarzamy w celu zapewnienia prawidłowego działania strony i portalu, wykrywania błędów, zapobiegania atakom, nadużyciom i nieuprawnionemu dostępowi oraz dokumentowania zdarzeń związanych z bezpieczeństwem.
Podstawą przetwarzania jest art. 6 ust. 1 lit. f RODO, a w wymaganym zakresie także art. 6 ust. 1 lit. c w związku z art. 32 RODO.
Marketing i informacje o usługach
Informacje handlowe i marketingowe przesyłamy wyłącznie wtedy, gdy jest to zgodne z przepisami RODO oraz Prawa komunikacji elektronicznej. Jeżeli przepisy wymagają zgody na wykorzystanie określonego kanału komunikacji, wiadomość zostanie wysłana dopiero po jej uzyskaniu.
Zgodę można wycofać w każdej chwili. Można również w dowolnym momencie zgłosić sprzeciw wobec wykorzystywania danych do marketingu bezpośredniego.
6. Zdjęcia i dokumenty dotyczące szkody
Zdjęcia oraz dokumenty przesłane przez formularz lub portal mogą zawierać dane osobowe, numery rejestracyjne, numery VIN, wizerunki osób, treść dokumentów i metadane plików.
Osoba przekazująca materiały dotyczące innych osób powinna posiadać podstawę prawną do ich przekazania. Przed przesłaniem należy w miarę możliwości usunąć zbędne dane, w szczególności niepotrzebne fotografie dokumentów tożsamości, dane medyczne, wizerunki osób postronnych oraz informacje o lokalizacji zapisane w pliku.
Dokumentacji szkody, danych dotyczących zdrowia i innych informacji poufnych nie należy przesyłać przez publiczne komentarze ani profile w mediach społecznościowych. Do przesyłania takich materiałów należy korzystać z portalu lub innego uzgodnionego, bezpiecznego sposobu przekazania danych.
7. Komu możemy udostępniać dane
Dane mogą otrzymać wyłącznie osoby i podmioty, które potrzebują ich do wykonania określonego zadania albo są uprawnione do ich otrzymania na podstawie prawa.
Odbiorcami danych mogą być w szczególności:
upoważnieni członkowie organów Stowarzyszenia, pracownicy i współpracownicy;
rzeczoznawcy oraz lokalni partnerzy wykonujący oględziny lub opinię;
zleceniodawcy, właściciele pojazdów i inne osoby uprawnione do otrzymania opinii;
ubezpieczyciele, brokerzy, likwidatorzy szkód i pełnomocnicy;
warsztaty naprawcze i dostawcy kalkulacji, wycen oraz danych technicznych;
dostawcy hostingu, poczty elektronicznej, chmury, portalu, kopii zapasowych, obsługi informatycznej i cyberbezpieczeństwa;
księgowi, doradcy podatkowi, prawnicy, banki i operatorzy płatności;
sądy, policja, organy administracji i inne instytucje uprawnione na podstawie prawa.
Podmioty przetwarzające dane na nasze zlecenie działają na podstawie odpowiednich umów i mogą wykorzystywać dane wyłącznie zgodnie z naszymi udokumentowanymi poleceniami.
Nie sprzedajemy ani nie wynajmujemy danych osobowych.
8. Przekazywanie danych poza Europejski Obszar Gospodarczy
W miarę możliwości korzystamy z usługodawców przetwarzających dane na terenie Europejskiego Obszaru Gospodarczego.
Jeżeli korzystanie z określonej usługi wiąże się z przekazaniem danych poza EOG, odbywa się to na podstawie mechanizmu przewidzianego w RODO, w szczególności decyzji Komisji Europejskiej potwierdzającej odpowiedni poziom ochrony albo standardowych klauzul umownych.
W razie potrzeby stosujemy dodatkowe zabezpieczenia, takie jak szyfrowanie, ograniczenie zakresu przekazywanych danych lub kontrola dostępu.
9. Jak długo przechowujemy dane
Dane przechowujemy tylko tak długo, jak jest to potrzebne do realizacji celu, dla którego zostały zebrane.
W szczególności:
dane dotyczące zapytania przechowujemy do zakończenia korespondencji, a następnie przez okres potrzebny do wykazania jej przebiegu;
dokumentację zlecenia i szkody przechowujemy przez czas realizacji i rozliczenia sprawy, a następnie do upływu właściwych terminów przedawnienia lub przez okres wymagany przepisami;
dokumenty księgowe i podatkowe przechowujemy przez okres wymagany prawem;
dane członków i certyfikowanych rzeczoznawców przechowujemy przez czas członkostwa lub ważności certyfikacji, a następnie przez okres niezbędny do udokumentowania ich przebiegu;
dane kandydatów, którzy nie zostali przyjęci, przechowujemy zasadniczo nie dłużej niż 12 miesięcy od zakończenia postępowania, chyba że istnieje inna podstawa ich dalszego przechowywania;
logi techniczne przechowujemy przez okres niezbędny do zapewnienia bezpieczeństwa i wyjaśnienia ewentualnego incydentu;
dane dotyczące zgód marketingowych przechowujemy do czasu wycofania zgody, a niezbędny dowód jej udzielenia lub wycofania – do upływu terminu przedawnienia roszczeń;
kopie zapasowe są usuwane lub nadpisywane zgodnie z przyjętym cyklem tworzenia kopii bezpieczeństwa.
Po upływie właściwego okresu dane są usuwane, anonimizowane albo blokowane, jeżeli dalsze ograniczone przechowywanie wynika z przepisów.
10. Pliki cookies i podobne technologie
Serwisy MOTOEXPERT mogą korzystać z plików cookies, pamięci lokalnej przeglądarki oraz podobnych technologii.
Technologie niezbędne mogą być wykorzystywane w celu:
prawidłowego wyświetlania i działania strony;
utrzymania sesji i logowania;
zapewnienia bezpieczeństwa;
zapamiętania ustawień prywatności;
wykonania funkcji wyraźnie wybranej przez użytkownika.

MOTOEXPERT może prowadzić profile w serwisach społecznościowych. Operatorzy tych serwisów przetwarzają dane również na własnych zasadach i mogą zbierać informacje o korzystaniu z ich usług.
Osadzone filmy, mapy, widżety lub inne treści zewnętrzne mogą powodować przekazanie dostawcy adresu IP oraz danych dotyczących urządzenia. Jeżeli dana usługa nie jest niezbędna do działania strony, zostanie uruchomiona dopiero po uzyskaniu wymaganej zgody.
Samo umieszczenie odnośnika do zewnętrznej strony nie powoduje przekazania danych do czasu kliknięcia w link.
12. Bezpieczeństwo danych
Stosujemy środki techniczne i organizacyjne odpowiednie do rodzaju danych oraz ryzyka związanego z ich przetwarzaniem.
Obejmują one w szczególności:
szyfrowanie transmisji;
kontrolę dostępu i uprawnień;
ograniczenie dostępu do osób, które potrzebują danych do wykonania swoich obowiązków;

Wycofanie zgody nie wpływa na zgodność z prawem przetwarzania dokonanego przed jej wycofaniem.

15. Dobrowolność podania danych
Podanie danych jest co do zasady dobrowolne. Niektóre dane są jednak konieczne do udzielenia odpowiedzi, zawarcia lub wykonania umowy, przeprowadzenia oględzin, sporządzenia opinii, przyjęcia do Stowarzyszenia, przeprowadzenia certyfikacji, wystawienia faktury albo rozpatrzenia reklamacji lub skargi.
Brak wymaganych danych może uniemożliwić wykonanie danej czynności lub usługi.
16. Zautomatyzowane podejmowanie decyzji
Nie podejmujemy wobec osób decyzji wywołujących skutki prawne lub wpływających na nie w podobnie istotny sposób wyłącznie na podstawie zautomatyzowanego przetwarzania danych.
Narzędzia wspierające kalkulację kosztów, wycenę pojazdów lub porządkowanie dokumentów nie zastępują merytorycznej oceny rzeczoznawcy.
17. Dane osób małoletnich
Serwisy i usługi MOTOEXPERT nie są kierowane do dzieci. Dane osób małoletnich mogą znaleźć się w dokumentacji szkody wyłącznie wtedy, gdy jest to niezbędne do prowadzenia sprawy i zgodne z prawem.
Osoba małoletnia nie powinna samodzielnie zakładać konta ani przesyłać dokumentacji bez udziału przedstawiciela ustawowego, jeżeli taki udział jest wymagany przepisami.
18. Zmiany Polityki Prywatności
Polityka Prywatności może być aktualizowana w przypadku zmian przepisów, zakresu usług, sposobu działania serwisów lub wykorzystywanych technologii.

2. Scope of this Privacy Policy
This Privacy Policy applies to MOTOEXPERT websites, forms, portals, subdomains and other online services that refer to this document.
This Policy also covers the processing of data in connection with:
handling enquiries and vehicle appraisal assignments;
organising vehicle inspections;
preparing technical reports and valuations;
handling motor vehicle damage and insurance claims;
uploading photographs, documents and other claim-related materials;
managing user and vehicle expert accounts;
membership of the Association;
certification, training and verification of qualifications;
handling complaints, claims and appeals;
communication with customers, vehicle experts, partners, insurers and other parties involved in claim-handling procedures.
Independent vehicle experts and businesses cooperating within the MOTOEXPERT network may, in certain circumstances, act as separate data controllers. This applies in particular where a vehicle expert performs an assignment in their own name and independently determines how personal data is processed. Information concerning the role of the relevant entity may be provided when a specific assignment is accepted or referred.

Depending on the nature of the matter, we may process:

telephone number and e-mail address;
company name, job title and contact person details;
invoicing and payment details;
vehicle data, including make, model, registration number, vehicle identification number (VIN), mileage, equipment and repair history;
information concerning the incident, the location and circumstances of the damage and the persons involved;
details of the vehicle owner, keeper or user;
details of drivers, passengers, witnesses, authorised representatives, repair shop employees and other persons connected with the matter;
photographs, recordings, cost estimates, invoices, repair calculations, vehicle documents, insurance documents and other evidence;
technical data associated with the use of the website or portal, such as the IP address, date and time of connection, device type, browser, operating system, session identifier and login history;
the contents of correspondence, complaints, claims, appeals and reports;
information concerning the education, experience, authorisations, specialisations and qualifications of applicants for membership, members and vehicle experts.
Claim documentation may, in exceptional circumstances, contain information concerning the health or injuries of persons involved in an incident. We process such data only where it is necessary to establish the circumstances of a claim, assert legal claims or defend against legal claims, or where the person concerned has given their explicit consent.
Please do not submit personal data, photographs or documents that are not necessary for handling the relevant matter.

We primarily obtain personal data directly from the persons concerned. Personal data may also be provided by:
the client commissioning the service;
the vehicle owner or user;
an insurer, insurance broker or claims adjuster;
an authorised representative or law firm;
a repair shop;
a MOTOEXPERT vehicle expert or partner;
a witness or another person involved in the incident;
a court, the police or another authorised public authority;
publicly accessible registers;
another entity authorised to disclose the data.
Where we receive personal data from another person or institution, we fulfil the applicable information obligations within the scope and time limits required by the GDPR.
5. Purposes and Legal Bases for Processing
We process personal data for the following purposes:
Handling enquiries and preparing quotations
We use data provided by telephone, e-mail or an online form to respond to enquiries, prepare quotations and take steps prior to entering into a contract.
The legal basis for processing is Article 6(1)(b) GDPR. Where the person contacting us acts on behalf of a company or another person, processing is based on our legitimate interests pursuant to Article 6(1)(f) GDPR.
Performing vehicle appraisal assignments
We process personal data to accept an assignment, arrange the date and location of an inspection, appoint a suitable vehicle expert, carry out the inspection, prepare a technical report, determine the value of a vehicle, calculate repair costs, determine the amount of damage, perform quality control and provide documentation to authorised recipients.
Depending on the nature of the assignment and the person whose data is processed, the legal basis is Article 6(1)(b), (c) or (f) GDPR.
Operating the portal and transferring documents
We process personal data to create and manage accounts, verify user authorisations, enable documents and photographs to be uploaded and downloaded, maintain the assignment history, ensure security and prevent unauthorised access.
